In the early morning hours of Wednesday, March 23rd 2006 the British Columbia ferry 'Queen of the North' hit rocks, took on water and sank. Ninety nine people were rescued; two persons are missing. The Queen of the North was a well equipped 125m (400 ft) long vessel capable of carrying 700 people and 115 vehicles. The ship had run this route for more than 25 years with an experienced crew. The accident was completely unexpected, grossly out of context for Canadian ferries, and came as a stunning shock to the ship's crew, surviving passengers, British Columbians and all Canadians. A week after the accident the Royal Canadian Mounted Police are investigating possible management criminal liability under Canada's Bill C-45 (similar to the USA's Sarbanes-Oxley legislation). Could this happen to you?

Bill C-45 deals with criminal liability of organizations including corporations and unions. It also applies to Crown Corporations and agents of the Crown. It applies:
  • when the actions of those with authority and other employees, taken as a whole, demonstrate a lack of care constituting criminal negligence
  • to senior officers who oversee day-to-day operations but who may not directors or executives and
  • when officers with executive or operational authority become aware of offences being committed by other employees but do not take action to stop them
In the months (and possibly years) ahead every aspect of the Queen of the North sinking will be meticulously investigated. Could your organization withstand this level of scrutiny?
